Trade court rules TRUMP’s 10% global tariff is illegal

Friday, May 8, 2026- A U.S. trade court has ruled that a 10% global tariff imposed under policies associated with Donald Trump is illegal, marking a significant legal setback for one of the administration’s most aggressive trade measures.

The ruling found that the tariff exceeded the authority granted under federal trade law, raising questions about how far executive power can extend in setting broad import duties without explicit congressional approval.

The decision is expected to have immediate implications for businesses and importers who were subject to the tariff, with potential ripple effects across global supply chains.

Companies that faced higher costs due to the tariff may now seek refunds or adjustments, while trade partners are likely to reassess ongoing negotiations and pricing strategies. Legal experts say the ruling could also trigger additional challenges to similar tariff policies if they are deemed to lack a clear statutory basis.

The case adds another layer of uncertainty to U.S. trade policy at a time when global markets are already sensitive to geopolitical tensions and shifting economic rules.

While the administration may appeal the decision, the ruling underscores ongoing debates over presidential authority in trade enforcement and the balance of power between the executive branch and Congress in shaping international economic policy.
